This early Code of Conduct (the “Code”) developed in the UK in 2002 by HM Treasury sets out the basis upon which individual Authorities were to approach the refinancing by private sector contractors of early PFI transactions.

The  guidance note is designed to assist public sector procurers to choose the right moment to enter into exclusive negotiations with a preferred bidder following competition and to carry out the negotiations in a fair and cost effective manner.
